EVENT OVERVIEW:

Get ready for a burst of color and excitement in support of local youth! This family-friendly Color Run welcomes kids, teens, and adults to enjoy a scenic riverfront course, vibrant color stations, and plenty of fun. All proceeds benefit the Boys & Girls Clubs of Volusia/Flagler Counties

Acknowledgment, Waiver, and Release:

I, _______________________________ (“Participant”), understand and agree that, as consideration for my voluntary participation in the Color Run for Success (“Event”), I am responsible for paying the entry fee (“Fee”). My participation may be revoked if I engage in inappropriate, disruptive, or illegal behavior, as determined solely by the Event organizer. I acknowledge that participation is potentially hazardous, certify that I am physically fit, and understand that the Event may be postponed, rescheduled, or canceled due to circumstances beyond the organizer’s reasonable control without refund.

I voluntarily assume all risks associated with participation, including falls; contact with other participants; effects of weather (including heat and humidity); and roadway/traffic conditions. For safety, bicycles, jogging strollers, in-line skates, skateboards, and animals are not permitted. By participating, I and my heirs, executors, administrators, and assigns waive, release, and hold harmless the Boys & Girls Clubs of Volusia/Flagler Counties, Brown & Brown Insurance, Runners High Timing and Race Management, Daytona Beverages LLC, all suppliers, sponsors, partners, and their respective directors, officers, affiliates, employees, agents, assigns, and representatives (collectively, “Releasees”) from any and all claims, damages, losses, liabilities, and expenses (including attorneys’ fees), whether or not due to the negligence of Releasees, arising out of my participation. I agree to indemnify and hold harmless Releasees from claims arising from my actions.

I grant Releasees the right to use my personal information, photograph/likeness, recordings, and statements for legitimate purposes, worldwide and in perpetuity, in any media without additional compensation. Florida law governs this agreement; disputes will be resolved by binding arbitration in Florida under the Commercial Rules of the American Arbitration Association. If I am unable to consent, I authorize first aid or medical treatment and release providers of such care and Releasees from related liability. I affirm that I have read, understand, and agree to these terms. If Participant is under 18, the undersigned parent/guardian represents authority to accept these terms on the Participant’s behalf.
